1. Eligibility and Age Requirements

AusGrader is designed for users aged 13 years and above.

  • You must be at least 13 years old to create an account and use AusGrader.
  • If you are under 18 years of age, you must have consent from a parent or legal guardian to use this service.
  • By creating an account, users under 18 confirm that their parent or guardian has reviewed these Terms and consents to their use of AusGrader.

Parents and guardians who consent to their child's use of AusGrader agree to be bound by these Terms on behalf of their child.

2. Educational Purpose

AusGrader is an education platform designed to help students practise exam questions from Australian curriculum authorities including QCAA, SCSA, VCAA, and NESA. The service provides AI-generated feedback that should be used as a study aid, not as a replacement for teacher feedback, official marking guides, or formal assessments.

3. Independent Study Tool

AusGrader is an independent study tool. It is not affiliated with, endorsed by, or operated by VCAA, QCAA, NESA, SCSA, or any Australian government entity. For official curriculum information, exam papers, results, and assessment policy, please visit each authority's official website linked in the sections below.

4. Licence to Use

We grant you a limited, non-exclusive, non-transferable licence to use AusGrader for personal, non-commercial, educational purposes only.

Under this licence, you must not:

  • Copy, modify, or redistribute platform materials (other than your own study responses)
  • Use the platform for commercial gain or public display
  • Attempt to decompile, reverse engineer, or hack the service
  • Remove copyright notices or proprietary attributions
  • Misuse the service in a way that disrupts learning for others

This licence automatically terminates if you violate these Terms.

5. User Accounts

  • You are responsible for keeping your login credentials secure.
  • You must not share your account with others.
  • You agree to notify us promptly if you suspect any unauthorised use of your account.

6. Content and Accuracy

While we strive for accuracy, AusGrader makes no guarantees about the completeness, reliability, or accuracy of any AI-generated feedback.

Feedback should be treated as guidance only and not as a definitive measure of exam performance.

7. QCAA Content

AusGrader uses past exam materials provided by the Queensland Curriculum and Assessment Authority (QCAA) under the Creative Commons Attribution 4.0 International licence.

  • Original QCAA materials remain the property of QCAA.
  • We make no claim of ownership over QCAA content.
  • The Queensland Curriculum and Assessment Authority does not endorse this product.

Original QCAA exam materials can be accessed directly at www.qcaa.qld.edu.au.

8. SCSA Content

AusGrader uses syllabus extracts and adapted ATAR Course Examination and Marking Key materials from the School Curriculum and Standards Authority (SCSA) under a paid licence agreement.

  • Original SCSA materials remain the property of the School Curriculum and Standards Authority.
  • We make no claim of ownership over SCSA content.
  • The School Curriculum and Standards Authority does not endorse this publication or product.
  • SCSA material is not to be changed without prior permission from the Authority.

9. VCAA Content

AusGrader uses VCE examination questions, extracts from Assessor Reports, and VCE Study Design extracts (key knowledge points, outcome statements) from the Victorian Curriculum and Assessment Authority (VCAA) under a paid licence agreement.

10. NESA Content

AusGrader uses HSC examination papers, marking guidelines, and syllabus outcomes from the NSW Education Standards Authority (NESA) under a paid licence agreement.

  • Original NESA materials are Crown copyright and remain the property of the NSW Education Standards Authority.
  • We make no claim of ownership over NESA content.
  • The NSW Education Standards Authority (NESA) does not endorse this product or service.
  • NESA takes no responsibility for any errors in the reproduction of NESA materials.
  • Any sample examination papers or model answers accompanying the NESA materials are not part of the NESA materials and are in no way endorsed or authorised by NESA.

11. Your Content

You retain ownership of any exam responses and written content you submit to AusGrader. By submitting content, you grant us a limited licence to process your responses through our AI grading system (powered by OpenAI) solely for the purpose of providing feedback. Neither AusGrader nor OpenAI uses your submitted responses to train AI models.

AI-generated feedback provided by the platform is owned by AusGrader and is licensed to you for personal educational use only.

By using AusGrader, you agree that we may generate aggregated, anonymous performance statistics from exam results across the platform (for example, average scores per question or subject). This data does not identify you personally and may be displayed to other users of the platform.

12. Account Termination

  • You may close your account at any time by contacting us at info@ausgrader.com.
  • We may suspend or terminate your account if you breach these Terms, misuse the platform, or engage in conduct that is harmful to other users.
  • Upon termination, your right to use AusGrader ceases immediately. You may request deletion of your data in accordance with our Privacy Policy.

13. Privacy

Your use of the platform is also governed by our Privacy Policy. By using AusGrader, you consent to our collection and use of your information as described there.

14. Payments and Paid Access

AusGrader offers an optional paid tier that unlocks premium features (including unlimited grading and unlimited custom test downloads). The price is shown at checkout in Australian dollars (AUD).

If you are under 18, you may only purchase paid access with the permission of your parent or guardian, who agrees to these payment terms on your behalf.

  • Paid access is a one-time payment that grants 12 months of access. It is not a subscription and does not auto-renew.
  • When your 12 months of access end, your account automatically returns to the free tier.
  • The free tier has usage limits (currently 25 graded questions and 3 custom test downloads). These limits may change over time.
  • Payments are processed securely by Stripe. We never receive or store your card details.
  • We are not currently registered for GST, so no GST is charged on your purchase.

We may change our prices or the features included in each tier at any time. Any change applies only to future purchases and does not affect access you have already paid for.

Promotional or discount codes, where offered, may be limited in time and in the number of redemptions, and may be withdrawn at any time.

15. Refunds

If you change your mind, you may request a refund within 7 days of your purchase, as long as you have graded no more than 15 questions and downloaded no more than 3 custom tests since upgrading. Approved refunds are returned through Stripe to your original payment method, and your paid access ends once the refund is processed.

Nothing in this section limits any rights you have under the Australian Consumer Law. You may still be entitled to a refund or other remedy for a major failure, and these rights cannot be excluded.

16. Limitation of Liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where we are entitled to limit our liability, our liability for a failure to comply with a consumer guarantee is limited to resupplying the service or paying the cost of resupply.

Subject to the rights described above, and to the maximum extent permitted by law:

  • AusGrader is provided "as is" and "as available".
  • We are not responsible for any damages resulting from use or inability to use the platform.
  • We are not liable for impacts on academic results, exam outcomes, or study performance.

17. Service Availability

We aim to keep AusGrader available but do not guarantee uninterrupted access.

The service may be updated, suspended, or discontinued at any time without notice.

18. Changes to Terms

We may revise these Terms from time to time. Updates will take effect immediately when posted. Your continued use of AusGrader after changes are posted means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of Victorian courts.
