School Terms of Service

For schools and educational institutions using AusGrader

These School Terms of Service ("School Terms") govern the use of AusGrader by schools, educational institutions, and their authorised staff. These terms supplement AusGrader's general Terms of Use and Privacy Policy, which continue to apply to all users. In the event of a conflict, these School Terms take precedence for institutional use.

1. Definitions

  • "School" means the educational institution that has entered into an arrangement with AusGrader for institutional use of the platform.
  • "Authorised Representative" means the teacher, head of department, or school administrator who manages the School's AusGrader account and acts as the primary point of contact.
  • "School Users" means the teachers and students who access AusGrader through the School's institutional arrangement.
  • "School Code" means the unique code provided by AusGrader to the School, used by teachers and students to join the School's account on the platform.

2. School Registration and Access

Access to AusGrader's institutional features is provided via School Codes. AusGrader provides a teacher code to the School, which allows teachers to register and join the School's account. Teachers then create classes and distribute student codes to their students.

The School is responsible for:

  • Ensuring School Codes are distributed only to authorised teachers and students
  • Keeping School Codes confidential and not sharing them publicly
  • Notifying AusGrader promptly if a School Code is compromised
  • Ensuring that all School Users are made aware of and agree to the general Terms of Use and Privacy Policy

3. Teacher Accounts and Responsibilities

Teachers registered under a School account have access to additional features, including the ability to:

  • Create and manage classes within the School
  • View individual student responses, grades, and AI-generated feedback
  • View aggregated class-level analytics and performance summaries
  • Distribute student codes to students for class enrolment

Teachers are responsible for using student data solely for legitimate educational purposes. Teachers must not share, export, or disclose individual student data to any third party outside the School, except as required by law or school policy.

4. Student Data and Privacy

AusGrader takes the privacy of student data seriously. In the context of school use:

  • Student data collected through the platform includes account information (name, email), exam responses, grades, and AI-generated feedback.
  • Student data is used solely to provide educational services, including AI-powered grading, feedback, and learning analytics.
  • Student data is never used for advertising, marketing, or AI model training.
  • Teachers within the School can view individual student data for their classes only.
  • AusGrader does not sell, rent, or trade student data to any third party.
  • AusGrader may generate and display aggregated, de-identified performance statistics from exam results across the platform (for example, average scores). This data cannot identify individual students or schools and is separate from class-level analytics visible only to the School's teachers.

5. Data Processing and Storage

All account and learning data is stored on AWS servers in Sydney, Australia (ap-southeast-2 region) via Supabase. Data is encrypted in transit using TLS and encrypted at rest.

To provide AI-powered grading and feedback, exam questions and student responses (without personal identifying information) are sent to our AI providers for processing. Our AI providers do not use submitted data to train their models. For details on cross-border data transfers, see Section 7 of our Privacy Policy.

AusGrader maintains appropriate technical and organisational measures to protect student data, including:

  • Encryption in transit (TLS) and at rest
  • Role-based access controls limiting data access to authorised personnel
  • Secure authentication via Supabase Auth
  • Regular review of security practices

6. Subscription and Payment

School subscriptions are billed on a per-student, per-year basis. Pricing and payment terms are agreed upon between the School and AusGrader prior to the subscription commencing.

Free Trial: AusGrader may offer schools a free trial period. The terms of any free trial, including duration and scope, are agreed individually between the School and AusGrader. During a free trial, these School Terms apply in full.

Invoicing: Schools are invoiced according to the terms agreed at the time of subscription. Payment is due within the timeframe specified on the invoice.

7. Subscription Expiry and Account Downgrade

If a School's subscription expires, is not renewed, or the School chooses not to proceed with a paid subscription after a free trial:

  • Teacher and student accounts linked to the School will be downgraded to individual free accounts.
  • Teachers will lose access to class management, student data viewing, and institutional analytics features.
  • Students will retain access to their own individual accounts and personal learning history.
  • No student or teacher data will be deleted as a result of subscription expiry.

The School may request deletion of all School-linked data at any time by contacting us at info@ausgrader.com.

8. Data Retention and Deletion

AusGrader retains School User data for as long as the School's subscription is active. Upon request from the School's Authorised Representative, AusGrader will:

  • Delete all student data associated with the School within 30 days of receiving a written request
  • Provide confirmation of deletion once complete
  • Export School data in a standard format upon request, prior to deletion

Individual students may also request deletion of their own data at any time, independently of the School, as outlined in our Privacy Policy.

9. Acceptable Use

The School agrees that AusGrader will be used for legitimate educational purposes only. The School must ensure that School Users:

  • Use the platform in accordance with the general Terms of Use
  • Do not share account credentials or School Codes with unauthorised persons
  • Do not attempt to misuse, disrupt, or interfere with the platform
  • Do not use AI-generated feedback as formal assessment results
  • Do not upload, publish, or distribute any content through the platform that they do not own or have appropriate rights or licences to use

The School warrants that any content uploaded to the platform by its teachers or staff (including questions, resources, and assessment materials) does not infringe the intellectual property rights of any third party. The School is solely responsible for ensuring it holds the necessary rights or licences for any content it uploads. AusGrader accepts no liability for copyright infringement arising from School-uploaded content.

AusGrader reserves the right to remove any content that it reasonably believes infringes third-party intellectual property rights, and to suspend access for any School User found to be in breach of these terms, after providing reasonable notice to the School's Authorised Representative.

10. Service Availability

AusGrader aims to maintain platform availability but does not guarantee uninterrupted access. The service is provided on a best-effort basis.

We will make reasonable efforts to notify schools of planned maintenance that may affect availability. In the event of unplanned downtime, we will work to restore service as quickly as possible.

11. Intellectual Property

All platform content, software, and AI-generated feedback remain the intellectual property of AusGrader or its licensors. QCAA materials are used under the Creative Commons Attribution 4.0 International licence and remain the property of QCAA.

Any content uploaded by the School or its teachers (including questions, resources, and assessment materials) remains the intellectual property of the School or its respective rights holders. Students retain ownership of their own written exam responses. The School does not acquire any intellectual property rights in the platform by entering into these terms.

12. Limitation of Liability

To the maximum extent permitted by Australian law:

  • AusGrader is provided "as is" and "as available".
  • AusGrader does not guarantee the accuracy of AI-generated feedback and it should not be used as a substitute for professional teacher assessment.
  • AusGrader is not liable for any impact on student academic results, exam outcomes, or assessment grades.
  • AusGrader's total liability to the School under these terms is limited to the fees paid by the School in the 12 months preceding the claim.

13. Indemnification

The School agrees to indemnify and hold harmless AusGrader and its officers, employees, and contractors from any claims, losses, or damages arising from the School's breach of these terms, misuse of the platform by School Users, or failure to obtain required consents from students or parents.

14. Data Breach Notification

In the event of a data breach affecting School User data that is likely to result in serious harm, AusGrader will:

  • Notify the School's Authorised Representative within 72 hours of becoming aware of the breach
  • Notify the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme
  • Take reasonable steps to contain the breach and mitigate any harm
  • Provide the School with information about the nature of the breach and the data affected

15. Term and Termination

These School Terms commence when the School first accesses AusGrader using a School Code and remain in effect for the duration of the subscription period.

Either party may terminate this agreement:

  • By providing 30 days written notice to the other party
  • Immediately, if the other party materially breaches these terms and fails to remedy the breach within 14 days of being notified

Upon termination, the provisions of these terms relating to data retention, deletion, liability, and indemnification survive.

16. Governing Law

These School Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of Victorian courts.
